PLEASE TAKE NOTICE that a public hearing will be held by the Board of Trustees of the Village of Millerton on April 20, 2022, at 6:00 p.m., at the Millerton Library Annex, 28 Century Blvd., Millerton, New York to hear all interested persons regarding Local Law “A” of 2022 entitled “A Local Law to abolish the Village of Millerton Police Department and Replace with Contracted Services”.

PLEASE TAKE FURTHER NOTICE that copies of said proposed Local Law are available for review at the Village Hall, 5933 North Elm Avenue, Millerton, New York and at the village website, www.villageofmillerton.net

All interested persons will be given an opportunity to be heard in person or by directing comments in writing to the Village Board of Trustees, 5933 North Elm Avenue, Millerton, New York, 12546.

VILLAGE OF MILLERTON LOCAL LAW NO. A (Proposed) OF 2022 A Local Law to Abolish the Village of Millerton Police Department and Replace with Contracted Services Be it enacted by the Board of Trustees of the Village of Millerton as follows: SECTION 1. LEGISLATIVE INTENT It is the intent of this local law to abolish the Village of Millerton Police Department. The Village has determined that entering into a shared services agreement with Dutchess County will reduce its tax levy and the attendant burden on Village taxpayers while still providing the Village with professional police protection. The Board of Trustees finds that abolition of the Village Police Department is in the public interest. SECTION 2. AUTHORITY This local law is adopted pursuant to NYS Village Law § 8-800, which expressly authorizes a village to abolish its police department. SECTION 3. ABOLITION OF POLICE DEPARTMENT The Board of Trustees of the Village of Millerton, Dutchess County, hereby abolishes its police department. All police services and functions shall be transferred by a contract for policing service with the Dutchess County Sheriff’s Office or any such entity with whom the Village subsequently validly contracts. SECTION 4. SEVERABILITY The provisions of this local law are severable. If any provision of this local law or the application thereof to any person, firm, corporation, or circumstance is adjudged invalid by a court of competent jurisdiction, such order or judgment shall not affect or impair the validity of the other provisions of this local law or the application thereof to other persons and circumstances.
